Abstract

Offenders who suffer from mental illnesses represent a vulnerable and highly marginalised group, facing everyday stigmatisation and discrimination, which has a negative impact on their re-socialisation and social reintegration and increases the risk of recidivism. It seems that adequate post-institutional assistance combined with gradual adaptation of the community and the shift in the attitude of the public towards these persons could contribute to the minimisation of their stigmatisation and discrimination and encourage their re-socialisation and social reintegration. Therefore, the author of this paper highlights the harmful impacts of stigmatisation and discrimination on the success of re-socialisation and social reintegration of offenders admitted with medical security measures, critically analyses current legislative framework of the Republic of Serbia for imposing and application of these measures as well as for post-institutional (post�penal) assistance that should follow them, suggesting ways to improve both - legislative solutions and practical aspects related to this complex issue.
